Upon shipping or payment for HEY Logistics shipment services and other conditions, the shipper and consignee agree to these terms and conditions. Shipment refers to any documents or parcels that travel under the HEYLOGISTICS waybill and may be transported by any means HEYLOGISTICS chooses, including air, road, sea, or any other carrier.
Liability: HeyLogistics' liability for any single shipment transported by air (including ancillary road transport or en route stops) is limited to the declared value of the item as shown on the waybill / invoice.
Billing and charges:
The Shipper's payment to the Carrier for the handling of goods and related services will be in accordance with the Carrier's standard tariffs, to be paid as determined by the Carrier from time to time.
Shipments that are not claimed within three working days of their arrival will be charged a daily demurrage fee of N500.00.
Goods conditions:
The burden of proving the quantity, type, physical properties and composition, and condition of the goods and/or the condition of any container at the time of receipt by the Carrier shall always rest with the Shipper, and no delivery note, receipt, or other document furnished or signed at such time by or on behalf of the Carrier shall constitute conclusive proof thereof.
Inspection privilege:
The Carrier has the right to inspect the goods without providing prior notice to the Shipper, including the right to open and examine the goods. HEYLogistics will not be liable for any subsequent complaints if the receiver does not ensure 100% inspection of the goods and acknowledges the condition of the goods before departure at the point of collection from the courier.
Deliveries:
Shipments shall be delivered to the Receiver's address given by the Shipper (which in the case of mail services shall be deemed to be the first receiving postal service and in the case of a central receiving area shall be delivered to that area), not necessarily to the named Receiver personally. If the Shipment is deemed unacceptable, or the Receiver cannot be reasonably identified, HEY Logistics shall use reasonable efforts to return the Shipment to Shipper at Shipper's expense; otherwise, the Shipment may be disposed of by HEY Logistics without incurring any liability.
Lien on the carrier:
The Carrier shall have a lien on all goods in its possession or under its control as security for money owed for the handling of the goods.
Shipper guarantees The Shipper agrees to indemnify and hold harmless the Carrier for any loss or damage resulting from the Shipper's failure to comply with any applicable laws or regulations, as well as the Shipper's breach of the following warranties and representations:
All information, descriptions, values, and other specifics provided to the Carrier are complete and correct.
The goods are the Shipper's sole property, or the Shipper has been authorized to enter into this agreement by the person who owns the goods.
The shipment is properly labeled, addressed, and packed to ensure safe transportation while being handled with care.
Payment of shipment fee by the Shipper's authorized representative the terms and conditions in this Agreement constitute binding and enforceable obligations on the Shipper;
Payment/Invoicing:
HEY Logistics will not ship or deliver packages until payment has been made and confirmed. Pickup or delivery will only be scheduled upon receiving confirmation of payment from the customer prior to any request.
Hazardous goods:
The shipper warrants that all goods handled are fit to be handled in the ordinary course of business and are not dangerous goods.
The Carrier will not handle any dangerous, corrosive, noxious, hazardous, inflammable, or explosive goods, or any goods that are likely to cause damage in its opinion. The Shipper is liable for all losses or damages caused by dangerous goods to the Carrier and/or third parties.
If, in the Carrier's opinion, any goods become a danger to any person or property, the Carrier shall be entitled to and shall take such steps in respect of the goods as it deems appropriate in its sole discretion. In such an event, the Carrier shall not be liable under any circumstances for the value of the goods or for any other loss or damage sustained by the Shipper or owner as a result of such steps and shall still be liable under any circumstances for the value of the goods or for any other loss or damage sustained by the Shipper or owner as a result of such steps and shall still be entitled to recover from the Shipper its remuneration for the handling of the goods together with any costs in connection therewith.
Abuse and Management: We reserve the right to not provide any further services in the event where a customer has been abusive and is endangering the staffs of the organization. This may result to terminating the customer's contract or refusing to provide further services to them.
Perishable items:
Perishable goods that are not picked up immediately upon arrival at their destination, are inadequately marked, or are otherwise unidentifiable, may be disposed of without notice to the Shipper.
Communication:
By accessing and using the Site, App or Services with a mobile device, Your acknowledge and agree that You may receive certain communications from the Site, App or Services including without limitation SMS, MMS, text messages, mobile emails, or other electronic communications means, collectively “Mobile Communications”. By accessing and using the Site, App or Services via mobile devices or PC, or by using certain mobile features including without limitation sending or receiving Mobile Communications, All communication outside this site is still binding to the terms of service of this website.
Route :
When transporting goods, The Carrier shall choose the route at its sole discretion.
Measurement:
HEY Logistics does not ship with factory/supplier measurement such as CBM or KG. We use airline stardard measurement. ALL goods might/shall be remeasured upon arrival to our warehouse. The measurement is un-adjustable upon arrival to the receiving country of choice.
Shipping Rate:
HEY Logistics shipping rates may change anytime due to the market update, We strongly advise you to confirm our rate via our official website to reduce any chances of delays of packages arrival/clearance.
Obligations of carriers:
Once the Carrier has delivered or handed the goods to the receiver stated in the waybill at the receiver's address or any other address the Carrier has been requested to deliver to, it will be deemed that the Carrier has discharged all of its obligations under this contract.
Insurance:
You may be asked to opt in for insurance for certain type of products and value. We strongly recommend shipping insurance either through our company or through other valid alternatives. HEY Logistics Limited will not be liable for any property loss, stolen, or damaged goods during transportation with the airline carriers if not insured.
* Standard Insurance = which is 20% - 40%% that covers 50% of the value
* Premium Insurance = which is 40% - 70% that covers 100% of the value.
Liability of the carrier for damage or loss:
The Carrier's liability for direct loss and damage is limited to the declared value of the shipment as stated on the waybill. Other types of loss or damage are not covered, including, but not limited to, lost profits, income, interest, and future business. The Carrier shall not be liable for any special or indirect loss or damage, even if the risks (financial or otherwise) associated with such loss or damage were communicated to the Carrier directly or indirectly prior to or after shipment acceptance.
Claims are limited to one per shipment, and settlement will be full and final settlement for all loss or damage associated with that shipment.
If the Shipper believes that the limits provided in Clauses 12.1 and 12.2 are insufficient, the Shipper must make a special declaration of value and take out insurance on the shipment as directed by the Carrier's staff in order to recover the full value of the goods, with the premium paid at the Shipper's expense, subject to an investigation and subsequent approval by the Carrier's management.
All claims must be submitted in writing to HEY Logistics within fourteen (14) days of the date HEY Logistics accepted the shipment, or HEY Logistics will be held harmless.
In the event where a package is incorrectly labelled, HEY Logistics will not be held responsible for the loss or damage of item(s).
Refund Procedure :
In the event where HEY Logistics is required to make a refund, all costs, expenses and insurance claim (if applicable) will be deducted and payment will be processed back into the “originating account” within 3 - 180 days Subcontracting:
The Carrier reserves the right to use subcontractors to perform services on its behalf and accepts no responsibility or liability to the Shipper for the acts or omissions of such third parties.
Forfeiture:
Shipments that are not collected or picked up within one month are forfeited to the carrier, who will dispose of the shipment accordingly.
Dispute:
In the event of a dispute arising from shipment, the parties must resolve it amicably. If the dispute, difference, or claim cannot be resolved amicably, the parties shall jointly appoint a sole arbitrator to arbitrate on the matter, after which the dispute, difference, or claim shall be referred to the Lagos Multi-Door Courthouse (LMDC) for Mediation, which shall be conducted in accordance with the LMDC Mediation Procedure Rules.
The law applicable to this agreement is the law of the Federal Republic of Nigeria.
Notices:
Notices must be served at the address specified on the waybill.
Terms in general:
These terms serve as the only record of the parties' agreement. Any express or implied term, representation, warranty, promise, or the like not recorded herein shall not bind the Carrier.
No relaxation or indulgence granted by the Carrier to the Shipper shall constitute a waiver of the Carrier's rights, regardless of when it arose.
Taxes and customs duties:
Please keep in mind that customs duties and taxes may apply in the destination country.
HEY Logistics has no control over these fees because they are set by the destination country's customs.
HEY Logistics is not liable for any delays caused by customs border control or Airlines.
Both the shipper and the receiver are responsible for providing all necessary documentation for customs clearance. If the shipper or receiver fails to provide this, the shipper will be charged for the shipment's return to the origin or auctioned to recoup expenses.
